Terms of Use

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the Fundi Concierge website at fundi.plus (the “Website”) and the Fundi Plus mobile and web application (the “App”), together with any related content, features, and services we make available through them (collectively, the “Platform”).

The Platform is operated by Fundi Concierge Ltd., a company incorporated in the Republic of Kenya (company registration number to be confirmed), with its registered office in Nairobi, Kenya (registered office address to be confirmed) (“Fundi Concierge”, “we”, “us”, or “our”). We trade under the brand name “Fundi Concierge” and operate the “Fundi Plus” application.

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Platform.

These Terms govern your use of the Platform only. The property-care services you request through the Platform (inspections, repairs, emergency response, projects, and membership) are governed by a separate Membership Agreement and the specific quotation and booking you accept. Where these Terms and the Membership Agreement conflict in relation to the services, the Membership Agreement prevails.

2. Eligibility

To create an account or use the Platform you must:

(a) be at least eighteen (18) years old and have the legal capacity to enter into a binding contract under Kenyan law;

(b) be a resident of, or own or manage property in, an area we currently serve; and

(c) provide accurate, current, and complete information about yourself and the property concerned.

If you use the Platform on behalf of an organisation (for example, as a property manager, agent, or company), you represent that you are authorised to bind that organisation, and “you” refers to both you and that organisation.

3. Our service, in summary

Fundi Concierge provides a membership-based property-care service in Kenya. Through the Platform you can, among other things: register a property; book and schedule inspections and jobs; receive quotations; authorise work; make payments; track jobs and technicians; view inspection reports and your property history; and raise emergencies.

Important limitations on the service (also set out in the Membership Agreement):

  • Emergency response is stabilisation, not a permanent repair. Where you raise an emergency, our objective is to make the situation safe and to contain damage (for example, closing a valve or isolating a circuit) within the response commitments and materials allowance of your membership tier. A permanent repair may require a separate, separately-quoted scope of work. Response commitments and allowances vary by tier — see your Membership Agreement and current tier inclusions for details.
  • We do not undertake all works. Some works fall outside our scope or safe capability. We may decline, pause, or refer works — including where a site is unsafe or where hazardous materials (for example, asbestos) are discovered.
  • Coverage is geographic and tier-based. Response times, inclusions, and material allowances depend on your membership tier and the region in which your property is located.

4. The Platform is a tool, not the service contract

The Website and App are the means by which you interact with Fundi Concierge. Booking a job, accepting a quotation, or paying a deposit through the Platform creates a service relationship governed by the Membership Agreement and the accepted quotation — not by these Terms alone. Nothing on the Platform (including indicative descriptions, prices, or availability) is an offer capable of acceptance until we confirm it.

5. Accounts and security

To use most features you must create an account. You agree to:

(a) keep your login credentials confidential and not share them;

(b) notify us immediately at security@fundiconcierge.com if you suspect any unauthorised use of your account;

(c) take responsibility for all activity that occurs under your account; and

(d) ensure that information in your account — including your property address, access arrangements, and contact details — is accurate and kept up to date.

We may suspend, restrict, or close your account in accordance with Section 13.

6. Booking, quotations, and payments

The Platform facilitates the following flow (which the Membership Agreement describes in full):

(a) Inspection and quotation. You request an inspection or job. We attend, assess, and prepare a written quotation, which you view in the App. We may call you to explain the scope and price.

(b) Confirmation window. Where dates are offered, you must confirm within three (3) days or the reserved dates may be released.

(c) Deposit. To lock in dates and cover materials, we may require a deposit of fifty percent (50%) of the quoted amount, with the balance payable as set out in the quotation or Membership Agreement.

(d) Payments. Payments are processed through our third-party payment provider, Paystack. We do not store your full card details. Your use of Paystack is subject to its own terms. All fees are stated in Kenya Shillings (KES) and are exclusive of VAT and applicable taxes.

(e) Refunds and cancellations are governed by the Membership Agreement. Deposits applied to materials already procured may be non-refundable to that extent.

You agree that all payments for services arranged through the Platform will be made through the Platform or channels we designate, and not directly to a technician (see Section 7).

7. Your responsibilities and acceptable use

When using the Platform and receiving our services, you agree that you will:

(a) provide safe and lawful access to the property at the scheduled time, or through an authorised person you have designated in the App;

(b) give accurate information about the property, its condition, and any known hazards;

(c) not engage or pay any Fundi Concierge technician off-platform, and not solicit, divert, or arrange work directly with a technician outside the Platform, during your membership and for six (6) months afterwards;

(d) not request or instruct a technician to perform work outside the scope of the confirmed booking or quotation;

(e) treat our staff and technicians with respect, and not harass, threaten, discriminate against, or endanger them (we operate a zero-tolerance policy and a technician may withdraw from an unsafe or abusive situation);

(f) not make false, misleading, or fraudulent claims (for example, attributing pre-existing damage to our work);

(g) not use the Platform for any unlawful purpose, or to upload content that is unlawful, infringing, or harmful; and

(h) not attempt to gain unauthorised access to, interfere with, reverse-engineer, scrape, or disrupt the Platform or its security.

8. Recording of jobs (audio and video) — your consent

To protect both you and our technicians — and to maintain an accurate record of the work performed, its scope, and the condition of the property — jobs may be recorded.

  • Audio recording is a minimum condition of service. By booking a job and by allowing a technician onto your property, you consent to audio recording of the visit and any related calls.
  • Video and photographic recording is used where you consent to it and is our preferred standard, given the visual nature of the work. Photographs and video also form part of your inspection reports and property history.
  • Where you decline video/photographic recording, you acknowledge that this may limit our ability to verify the work, assess damage disputes, and support any claim you later make.

How these recordings and images are stored, used, retained, and protected is explained in our Privacy Policy. You may withdraw consent to non-essential recording as described there, but we may be unable to provide, or continue to provide, certain services without the minimum recording described above.

9. Inspection reports, photos, and content

(a) Our content. The Platform, the “Fundi Concierge” and “Fundi Plus” names and logos, and all software, text, graphics, reports, templates, and other materials we provide are owned by or licensed to Fundi Concierge and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform and the reports we provide for your own property-management purposes. You may not copy, resell, or commercially exploit them without our written consent.

(b) Your content. You retain ownership of the content you submit (for example, photos, descriptions, and messages). You grant us a licence to use that content to provide the services, maintain your property record, and improve our services, as described in the Privacy Policy.

(c) Inspection data. Inspection findings, property-health scores, photographs, and reports are prepared with reasonable professional care but reflect the condition observed at the time of inspection and the scope agreed. They are not a warranty or guarantee of the property’s condition, and they are not a substitute for a statutory, structural, or specialist survey where one is required.

10. Third-party services

The Platform relies on and links to third-party services (for example, mapping, messaging such as WhatsApp, payment processing via Paystack, and cloud hosting). We are not responsible for the content, availability, or practices of those third parties, and your use of them may be subject to their own terms and privacy notices.

11. Disclaimers

To the fullest extent permitted by Kenyan law:

(a) the Platform is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, secure, or free of harmful components.

(b) The Platform is not an emergency service. In a life-threatening emergency, or where there is a risk to personal safety, you must contact the Kenyan emergency services (for example, 999 / 112) or the relevant utility provider directly. Raising an emergency in the App does not guarantee immediate attendance and is subject to the response commitments and coverage in your membership tier.

(c) Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.

12. Limitation of liability

To the fullest extent permitted by law:

(a) we are not liable for indirect, incidental, special, or consequential loss, or for loss of profit, revenue, data, or goodwill, arising out of or in connection with your use of the Platform;

(b) our total aggregate liability arising out of or in connection with the Platform (as distinct from liability under the Membership Agreement for the services themselves) is limited to the amounts you paid to us in the three (3) months preceding the event giving rise to the claim; and

(c) we are not liable for pre-existing defects or damage not caused by us, for damage arising from inaccurate information you provided, or for loss arising because access to the property was not provided as arranged.

Liability for the property-care services themselves (including workmanship, materials, and any insurance arrangements) is dealt with in the Membership Agreement.

13. Suspension and termination

(a) By you. You may stop using the Platform at any time and may request closure of your account by contacting support@fundiconcierge.com. Closing your account does not end any live service obligations or outstanding payments under the Membership Agreement.

(b) By us. We may suspend or terminate your access to the Platform, with or without notice, if you breach these Terms, fail to pay amounts due, provide false information, harass or endanger our staff, or use the Platform unlawfully or in a way that harms us or others.

(c) Effect. On termination, your right to use the Platform ends. Sections that by their nature should survive (including Sections 7, 9, 11, 12, 14, and 15) survive termination.

14. Changes to the Platform and to these Terms

We may update the Platform and these Terms from time to time. Where changes are material, we will give you reasonable notice (for example, by in-App notice or email) before they take effect. Your continued use of the Platform after the effective date of the updated Terms constitutes acceptance. If you do not agree to the updated Terms, you should stop using the Platform.

15. Governing law and dispute resolution

(a) These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the Republic of Kenya.

(b) The parties will first attempt to resolve any dispute amicably through good-faith discussions.

(c) Subject to (b), the courts of Kenya have exclusive jurisdiction, and you submit to the jurisdiction of those courts, regardless of where you are located when you use the Platform.

16. General

(a) Entire agreement. These Terms, the Privacy Policy, and (for the services) the Membership Agreement constitute the entire agreement between you and us regarding the Platform.

(b) Severability. If any provision is held to be invalid or unenforceable, the remaining provisions continue in full force.

(c) No waiver. Our failure to enforce any right or provision is not a waiver of it.

(d) Assignment. You may not assign your rights under these Terms without our consent. We may assign or transfer our rights and obligations, including on a sale or reorganisation of the business, on notice to you.

(e) Notices. We may give notice through the App, by email to the address on your account, or by posting on the Website.
